Appeals court overturns Hobby Lobby contraception coverage ruling

DENVER — An appeals court Thursday overturned the decision of a judge in Oklahoma City who refused to block parts of President Obama’s Affordable Care Act which conflict with Christian views of the owners of Hobby Lobby stores.

Judges of the 10th U.S. Circuit Court of Appeals, however, fell one vote short of ordering the lower-court judge to issue an injunction to block parts of the law that require Hobby Lobby to cover the cost of emergency contraception for its employees.

The Denver-based court, instead, instructed Judge Joe Heaton of U.S. District Court in Oklahoma City to reconsider his decision.

The 10th Circuit court’s newest judge, Robert Bacharach of Oklahoma City, voted partly against the position of Obama, who appointed him to the court.
