Challenge Filed To Tax Cut, Alleges One Subject Rule Violation
Attorney files legal challenge to Okla. tax cut

OKLAHOMA CITY (AP) — A bill celebrated by Republican leaders that slashes the state’s income tax rate and provides funding to repair the crumbling state Capitol violates the state Oklahoma Constitution because it addresses more than one subject, an Oklahoma City attorney alleges in a lawsuit filed Thursday.
Jerry Fent, an attorney with a long track record of successfully challenging legislative actions as unconstitutional, asked the state Supreme Court to take up the case.
Fent argues the bill is unconstitutional because it violates Article 5, Section 57, of the state Constitution which states in part: “Every act of the Legislature shall embrace but one subject, which shall be clearly expressed in its title.”
“(House Bill) 2032 includes multi subjects of substantive income tax law and an appropriation of general revenue for a capital repair fund all in violations of” the state Constitution,” the lawsuit states.
